How is the Marchman Act different than the Baker Act?
The Marchman Act is typically a process or procedure that’s used to assist somebody who has a substance abuse issue, whereas the Baker Act is typically a process or procedure that’s used to assist somebody who has a mental health issue. Where things get a little bit complicated is that typically somebody who has a substance abuse issue also tends to have a mental health issue, too. Sometimes the lines between Marchman Act and Baker Act can get crossed, and they get a little confused. Typically you’re asking the court in a Marchman Act procedure to address both of those issues because they tend to go hand in hand.
