SMS/Test Messaging Privacy Policy

Astor Simovitch, LLP

1. Introduction
Astor Simovitch, LLP (“we,” “us,” or “our”) respects your privacy. This SMS/Text Messaging Privacy Policy explains how we collect, use, and protect personal information when you opt in to receive text messages from us regarding consultation reminders and case status updates.

2. Information We Collect
When you enroll in our text message program, we may collect:

  • Your mobile phone number
  • Your name and basic contact details
  • Information related to scheduled consultations (date, time, location or method)
  • Limited case-related information necessary to identify the matter (for example, file or case number, party names, or short descriptors)
  • Message content you send to us in reply
  • Technical and engagement data (such as delivery status, date and time of messages, your responses)

We will not request or knowingly collect highly sensitive information (such as full Social Security numbers, credit card numbers, or detailed confidential legal strategies) via text message. You should not send such information by SMS.

3. How We Use Your Information
We use your information to:

  • Send appointment and consultation reminders
  • Provide case status updates and other case-related notifications
  • Confirm or reschedule consultations
  • Respond to your questions regarding scheduled meetings or your matter
  • Maintain records necessary for our legal practice, conflict checks, compliance, and audit purposes
  • Improve our communications and client service

We will not use your mobile number or other SMS-related information for marketing or advertising purposes without obtaining your separate, explicit consent.

4. Legal Basis and Consent
By providing your mobile phone number to Astor Simovitch, LLP and opting in to receive text messages, you:

  • Represent that you are the authorized user of the phone number provided or have permission from the authorized user
  • Consent to receive text messages from us at that number about consultation reminders and case status updates, including messages sent using automated technology to the extent permitted by law
  • Your consent to receive SMS messages is not a condition of entering into an attorney–client relationship or obtaining legal services, and you may communicate with us through other means at any time.

5. Message Frequency and Fees
Message frequency will vary based on your active matters and scheduled consultations (for example, reminders before appointments, notifications about case developments, or follow-up messages).

Standard message and data rates may apply to any messages sent or received, as provided in your mobile service plan. Contact your wireless provider for details.

6. Opt-Out and Help
You can opt out of receiving text messages from us at any time:

  • Text STOP in reply to any message to cancel. After you text STOP, we may send a confirmation text to verify that you have been unsubscribed.
  • You may also contact us at the office using the phone number or email address listed on our website to request removal from our SMS list.

For help or more information regarding our messages:

  • Text HELP in reply to any message, or
  • Contact Astor Simovitch, LLP at the office contact information provided on our website.

Even if you opt out of SMS communications, we may still contact you through other means you have authorized (such as phone calls, email, or mail) as appropriate for your representation and as permitted by law and applicable ethical rules.

7. Sharing and Disclosure of Information
We do not sell or rent your mobile phone number or SMS-related information to third parties. We may share your information only:

  • With service providers and vendors who assist us in delivering text messages and operating our systems, under appropriate confidentiality and data protection obligations
  • With courts, opposing counsel, or others as reasonably necessary in connection with your legal matter and consistent with applicable law and professional obligations
  • As required by law, regulation, court order, or governmental request
  • As reasonably necessary to protect the rights, property, or safety of Astor Simovitch, LLP, our clients, or others

We take steps to ensure that any third party with access to SMS-related information handles it in a manner consistent with this policy and with our professional responsibilities.

8. Confidentiality and Security
As a law firm, Astor Simovitch, LLP is committed to maintaining the confidentiality of client information in accordance with applicable law and professional ethics rules. However, text messaging is not a fully secure form of communication, and messages may be accessible to your mobile carrier or others with access to your device or account.

We use reasonable administrative, technical, and physical safeguards to protect the information we store, but we cannot guarantee absolute security. For highly sensitive or confidential matters, we may request that you communicate by phone, in person, or through other more secure channels.

9. Data Retention
We retain your personal information, including your mobile phone number and SMS logs, as long as necessary to:

  • Provide the text message services you requested
  • Service and maintain your legal matters
  • Comply with legal, ethical, and regulatory obligations (including recordkeeping requirements for law practices)
  • Resolve disputes and enforce our agreements

When information is no longer needed, we will retain or dispose of it in accordance with our records retention policies and applicable law.

10. Children’s Privacy
Our SMS program is intended for adults or individuals represented by a parent or legal guardian. We do not knowingly enroll children under the age of 13 in our SMS program. If we become aware that a child has provided us with personal information via SMS without appropriate authorization, we will take steps to delete that information where required by law.

7. Service Availability and Limitations
The SMS Service may not be available in all areas and may be affected by your carrier’s coverage or network issues. We do not guarantee that all carriers or devices support the SMS Service, nor do we guarantee that messages will be delivered without delay or error.

8. No Legal Advice via SMS

For detailed legal advice or to discuss strategy, you should schedule a consultation, call our office, or communicate through other agreed channels.

9. Privacy and Confidentiality
Your use of the SMS Service is subject to our SMS/Text Messaging Privacy Policy and to our general obligations of confidentiality as a law firm. While we strive to keep texts limited and discreet, text messaging is not perfectly secure. For sensitive topics, we may ask you to continue the conversation by phone, in person, or via another method.

10. Prohibited Uses
You agree not to use the SMS Service to send us messages that are:

  • Unlawful, threatening, abusive, harassing, defamatory, or fraudulent

  • You also agree not to attempt to gain unauthorized access to any systems, networks, or information associated with our SMS Service.

11. Limitation of Liability

13. Termination
We may suspend or terminate your access to the SMS Service at any time, with or without notice, including if we believe you have violated these Terms or applicable law, or if we discontinue or modify the SMS Service. You may terminate your participation at any time by opting out as described above.

14. Governing Law
These Terms and your use of the SMS Service are governed by the laws of the State of Florida, without regard to its conflict of laws rules, except as otherwise required by applicable law or ethical obligations.
