How is a Marchman Act petition filed?
There are two basic ways that a Marchman Act petition can be filed. If the parent or the guardian or the spouse is filing a petition without using an attorney, they would go down to the clerk of courts office and they would fill out the petition, and then it would get reviewed. If they’re using an attorney, the attorney’s going to assist them with that process. They’re going to help them to put together the petition. Then the attorney, using the Florida e file portal, is going to electronically file the petition, and then the clerk is going to review it. If you use an attorney the process is much simpler. It’s much more efficient, and so a lot less stressful.
