How is a Marchman Act petition filed?

There are two basic ways that a Marchman Act petition can be filed. If the parent, guardian, or spouse is filing the petition without using an attorney, they would go down to the Clerk of Court’s office and fill out the petition, and then it would get reviewed. If they’re using an attorney, the attorney is going to assist them with that process—they’re going to help them put together the petition, and then the attorney, using the Florida e-file portal, is going to electronically file the petition. Then the clerk is going to review it. So, if you use an attorney, the process is much simpler, it’s much more efficient, and it’s a lot less stressful.
